A BILL to amend article two, chapter eighteen of the code of West
Virginia, one thousand nine hundred thirty-one, as amended,
by adding thereto a new section, designated section
thirty-two, relating to the sale of packaged food and drinks
in secondary schools.
Be it enacted by the Legislature of West Virginia:
That article two, chapter eighteen of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
thirty-two, to read as follows:
ARTICLE 2. STATE BOARD OF EDUCATION.
§18-2-32. Sale of packaged food and drinks authorized.
No rule of the state board of education or a county board of
education may prohibit the sale of candy, cookies, crackers, soft
drinks or any other packaged food or drinks in the secondary
schools. The principal of each school, however, may choose which
foods and drinks are to be available and in what manner the foods
and drinks may be sold.
NOTE: The purpose of this bill is to permit the sale of
candy, soft drinks and other packaged foods in secondary schools.
